Acceptance of these Terms
These Terms of Service (the “Terms”) form a binding agreement between you and the operator of CatMind.ai (“CatMind”, “we”, “us” or “our”) governing your access to and use of the CatMind website, applications, analysis tools, accounts, content and related services (together, the “Platform”).
By continuing, creating an account, clicking “Register”, accessing or using the Platform, you confirm that you have read and agree to these Terms and acknowledge receipt of the Privacy Policy, including the Cookies Policy. If you do not agree to these Terms, do not register for or use the Platform.
Your registration also authorises the strictly necessary cookies and similar technologies required to provide authentication, security and the service you request. Optional analytics, advertising or other non-essential cookies are used only where you provide any separate consent required by applicable law.
You must be at least 18 years old, or the age of legal majority where you live, to create an account. If the Platform is used for or with a minor, a parent or legal guardian must supervise and accepts responsibility for that use.
What CatMind provides
CatMind is an experimental artificial-intelligence platform that analyses selected video, audio, movement, pose, scene and profile signals to produce observable-behaviour summaries and possible interpretations. Outputs may include confidence indicators, alternative hypotheses and technical evidence.
CatMind does not know what an animal thinks, feels, wants or needs. AI outputs are probabilistic, may be wrong, incomplete or misleading, and may change when models, thresholds or available evidence change. Camera movement, image quality, occlusion, background sound, scene objects, limited training data and other factors can create false positives or false negatives.
This is CatMind's single best current hypothesis. It is not a statement of proven intent, emotion, need, or health.
Confidence describes support for the visible and audible observation — not certainty about what your cat intends or feels.
These are plausible explanations, not conclusions from a validated intent, emotion, or medical model.
This is an experimental interpretation, not a veterinary diagnosis.
Your responsibility
Animal and personal safety comes first
You are solely responsible for deciding whether, when and how to record, handle, approach or interact with any animal. CatMind never requires an animal to perform, vocalise, approach, play, eat, move or display a particular behaviour.
Do not provoke, frighten, chase, restrain, corner, tease, startle, over-handle or force an animal to do anything for a recording. Do not withhold food, water, medication, rest or access to a safe space; induce vocalisation; encourage aggression; recreate distressing situations; or continue recording when an animal shows fear, stress, pain, avoidance or defensive behaviour.
Never use an animal in a staged test, experiment, challenge or attempt to verify a CatMind output. You must not place an animal in or near a household appliance, enclosed container, vehicle or other hazardous location; expose an animal to heat, cold, electricity, fire, deep water, dangerous heights, toxic substances, smoke, restricted air or physical pain; or deprive an animal of food, water, air, rest, medication, shelter, safe footing or the ability to leave.
You must not provoke or manufacture vocalisation, aggression, fear, pain, escape behaviour or a defensive reaction. A CatMind output is never an instruction, request, challenge or encouragement to recreate, induce or test any behaviour or situation.
You must assess the animal, environment and circumstances in real time, maintain a safe distance, protect all people and animals present, and stop immediately if there is any risk of injury or distress. Follow instructions from veterinarians, animal behaviour professionals and competent authorities.
Any injury, bite, scratch, fall, escape, distress, property damage or other harm caused by an animal to you or another person — or caused by you or another person to an animal — arising from filming, staging, handling, following an output or otherwise using the Platform remains your responsibility, except to the extent liability cannot lawfully be excluded.
To the maximum extent permitted by applicable law, you are solely responsible for all resulting medical, veterinary, rehabilitation, rescue, transport, property, accommodation, legal and other costs or expenses arising from your recording method, interaction, staging, misuse or prohibited conduct.
No veterinary, medical or emergency service
The Platform is not veterinary care, diagnosis, treatment, triage, behavioural therapy, medical advice or an emergency service. It is not a substitute for direct examination by a qualified veterinarian or other appropriate professional.
A behavioural interpretation — for example, that an animal may want to play — does not assess or establish the animal's overall health. It does not replace vaccination, parasite prevention, routine preventive veterinary examinations, age-appropriate care or consultation about symptoms. You remain responsible for arranging appropriate preventive and symptom-led veterinary care for your animal.
Never use a CatMind output to diagnose or treat an animal, select or change medication, delay professional care, or decide that urgent care is unnecessary. If you suspect pain, illness, poisoning, breathing difficulty, injury, sudden behavioural change or any emergency, contact a veterinarian or local emergency service immediately.
You control and are responsible for your decisions
You decide whether and how to use each output. You must independently evaluate results, consider alternative explanations, use common sense and seek qualified advice where appropriate. You assume the risks associated with your actions, omissions, recordings, interactions and reliance on Platform outputs.
You are responsible for your account, devices, internet connection, recording conditions, compliance with animal-welfare rules, privacy and image rights, property permissions, and all activity performed through your account. Keep your credentials confidential and notify us promptly if you suspect unauthorised access.
Uploaded media, permissions and feedback
You retain any rights you hold in video, audio, images, notes and other material you upload (“User Content”). You grant CatMind a limited, worldwide, non-exclusive licence to host, copy, process, adapt and display User Content only as needed to operate, secure, support and improve the Platform, subject to the Privacy Policy and your dataset-contribution choices.
You confirm that you have all rights and permissions needed to upload and process User Content, including permission from identifiable people and owners or custodians of animals or property appearing in it. Do not upload unlawful, confidential, infringing or unnecessarily sensitive content.
Where the interface offers a separate choice to contribute an example to the CatMind dataset, participation is optional and governed by the notice shown with that choice. General use of the Platform does not by itself grant permission for optional dataset contribution.
Where the interface offers Submit to Showcase, you may separately consent to CatMind reviewing and publicly displaying the exact pet name and basic profile, a compact copy of the profile photo when one exists, layered evidence frame, CatMind answer and Why analysis shown before submission. A generic cat illustration is used when no consented profile photo is available. Owner identity, email, account ID, location, pet notes and original filename remain excluded. Showcase never copies, retains or publishes video or audio and does not extend the retention of original analysis media. Submission does not guarantee publication. CatMind may approve or reject a contribution, and you may withdraw it from future public display; withdrawal removes the retained profile-photo and evidence-frame copies. Approved contributions receive one promotional analysis credit per submission, awarded once; withdrawal does not reverse that credit.
The Referral Sandbox permits one attribution per invited account. The invited user may receive one credit after email verification and a first successful analysis. The inviter may receive one credit after three successful analyses by that invited account across at least two UTC dates, or after its first confirmed purchase. A maximum of five referral credits may be awarded to one beneficiary per calendar month. Self-referral, duplicate accounts, coordinated abuse and attempts to manipulate qualification are prohibited. CatMind may review risk signals and revoke an unused suspicious award through a compensating ledger entry. IP or device matches alone do not automatically disqualify a referral.
Acceptable and prohibited use
You may use the Platform only lawfully and in accordance with these Terms. You must not:
- harm, endanger, distress or exploit an animal or person, or encourage anyone else to do so;
- upload, submit for analysis, store, share, promote or otherwise use the Platform in connection with content that depicts, facilitates, encourages or solicits sexual abuse or sexual exploitation of an animal, including bestiality or any other sexual activity involving an animal;
- place an animal in a hazardous appliance, container, vehicle, environment or situation, or expose an animal to heat, cold, electricity, fire, water, heights, toxic substances, restricted air, deprivation or physical pain;
- stage, recreate, induce or provoke behaviour, vocalisation, aggression, fear, pain or distress in order to record an animal, test the Platform or verify an output;
- use outputs as veterinary diagnoses, treatment instructions, proof of intent, or evidence of a person's or animal's legal culpability;
- upload content without the necessary rights, permissions or lawful basis;
- interfere with security, probe vulnerabilities, bypass access controls, overload the Platform, introduce malicious code or automate abusive requests;
- reverse engineer, extract models or datasets, scrape protected content, or use the Platform to build a competing model except where applicable law expressly permits it;
- misrepresent CatMind outputs, remove uncertainty language, or present experimental interpretations as established scientific or medical conclusions;
- use the Platform for unlawful surveillance, harassment, discrimination, fraud or any illegal purpose.
If CatMind becomes aware of content reasonably suspected to involve this conduct or another unlawful or prohibited use, we may reject or remove the content, restrict or terminate access, preserve relevant records where reasonably necessary, and disclose information to competent authorities where permitted or required by applicable law. CatMind does not undertake to monitor every upload and does not guarantee that prohibited content will always be detected.
Accounts, availability and changes
You may sign in using a verified email and password or an enabled third-party identity provider. You authorise CatMind to receive the basic identity claims needed to create, locate or link your account. You must not link an identity you do not control. Removing a linked provider is permitted only when another usable sign-in method remains.
We may set usage limits, change, suspend or discontinue features, and update models or outputs. We do not guarantee uninterrupted availability, preservation of temporary media, compatibility with every file or device, or that a particular result can be reproduced after the Platform changes.
When automated inactivity cleanup is enabled, a free-only account that has exhausted its trial and has no active subscription or remaining credits may be scheduled for deletion after 90 days without account activity. We plan to provide advance notices and cancel the schedule when the user signs in or confirms that the account should be kept. This short inactivity rule does not apply while purchased credits remain available. Separate retention may apply where required for security, disputes, tax, accounting or other legal obligations.
We may suspend or terminate access where reasonably necessary to protect animals, people, the Platform or other users; investigate suspected misuse; comply with law; or enforce these Terms. You may stop using the Platform at any time.
CatMind intellectual property
The Platform, software, models, interface, branding, documentation, analysis structure and all related intellectual property — excluding User Content — belong to CatMind or its licensors. We grant you a limited, personal, revocable, non-exclusive and non-transferable right to use the Platform in accordance with these Terms.
No warranties
To the maximum extent permitted by applicable law, the Platform and all outputs are provided “as is” and “as available”. CatMind disclaims all express, implied and statutory warranties, including accuracy, completeness, reliability, availability, fitness for a particular purpose, merchantability, non-infringement and that use will achieve any particular outcome.
We do not warrant that the Platform will identify an animal correctly, distinguish animal sound from background sound, detect risk, recognise pain or illness, infer intention, or produce the same interpretation as a veterinarian, behaviourist or another system.
Important limitation
Limitation of liability
You remain responsible for your conduct and for the consequences of recording, handling, approaching or acting in relation to an animal. To the maximum extent permitted by applicable law, CatMind is not liable for injury, death, distress, bites, scratches, escape, loss, property damage, medical or veterinary bills, rehabilitation or rescue costs, delayed veterinary care, incorrect decisions or any other consequence arising from your misuse of the Platform, unsafe recording practices, prohibited conduct, failure to supervise, breach of these Terms, or decision to act or not act based on an output.
To the maximum extent permitted by law, CatMind will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, loss of data, loss of opportunity, loss of profits or business interruption arising from or related to the Platform.
Where liability cannot legally be excluded, CatMind's aggregate liability arising from or relating to the Platform will be limited to the greater of (a) the amount you paid CatMind for the affected service during the 12 months preceding the event giving rise to the claim and (b) EUR 100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, or death or personal injury caused by CatMind's own act or omission where applicable law prohibits such exclusion. Mandatory consumer rights remain unaffected.
Responsibility for claims caused by misuse
To the extent permitted by applicable law, you are responsible for losses, liabilities, third-party claims and reasonable costs incurred by CatMind as a direct result of your unlawful User Content, deliberate misuse of the Platform, unsafe or prohibited recording practices, violation of another person's rights, harm to an animal, or material breach of these Terms. This includes, where legally recoverable, medical, veterinary, rescue, rehabilitation, property, investigation and reasonable legal costs caused by that conduct. This section does not reduce any non-waivable rights you have as a consumer.
Third-party services
The Platform may depend on or link to third-party hosting, AI, payment, authentication or other services. Their own terms and privacy practices may apply. CatMind does not control and is not responsible for third-party services, content or availability, except where applicable law provides otherwise.
Changes to these Terms
We may update these Terms to reflect changes to the Platform, law, safety practices or business operations. The updated version and effective date will be published on this page. Where required by law or where changes materially affect your rights, we will provide additional notice. Continued use after an update takes effect constitutes acceptance only to the extent permitted by applicable law.
Governing law and company information
These Terms are governed by the laws of the Netherlands. Courts in Rotterdam have jurisdiction, except where mandatory consumer law gives you the right to bring or defend proceedings in another competent court or to rely on mandatory protections in your country of residence.
If any provision is found invalid or unenforceable, it will apply to the maximum lawful extent and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver.
